This Privacy Policy outlines our practices for collecting, using, and disclosing your information when using the Application, and informs you about your privacy rights and legal protections. We utilize your personal data to enhance and refine the Service. By using this application, you agree to the collection and utilization of information outlined in this Privacy Policy. The policy governs your use of the software Applications (“Applications”) for mobile Devices hosted on the Apple Store and Google Play Store. The Applications primarily provide transportation-related Services delivery and aim to enhance citizen Services by the government. The content published on these Applications is provided by the relevant Ministries/Departments of State Government (SC) or allied government establishments.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

• Account means a unique account created for you to access our service or parts of our service.
• Affiliate means an entity that controls, is controlled by or is under common control with a party,where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
• Application refers to SCDMV, the software program provided by the Company.
• Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to South Carolina Department of Revenue
• Country refers to: South Carolina, United States
• Device means any Device that can access the service such as a computer, a cell phone, or a digital tablet.
• Personal Data is any information that relates to an identified or identifiable individual.
• Service refers to the Application.
• Service Provider means any natural or legal person who processes the data on behalf of the company. It refers to third-party companies or individuals employed by the company to facilitate the service, to provide the service on behalf of the company, to perform Services related to the service or to assist the company in analysing how the service is used.
• Usage Data refers to data collected automatically,either generated using the Service or from the service infrastructure itself (for example, the duration of a page visit).
• You refers to the individual accessing or using the Service, or the Company, or other legal entity on behalf of which such individual is accessing or using the service, as applicable.

User Provided Information:

Applications may collect information you provide during the download and registration process. Registration (only possible after creating an External user on the parent Application or having any special user role) is mandatory to access all features offered by the Application.

When you register and use the application, you generally provide (a) email address, username, password, and other registration information; (b) download or use Applications from us; (c) information you provide when you contact us for help; and (e) information you enter into our system when using the application, such as contact information and other details.

The information you provided may be used occasionally to contact you and provide important information and required notices.

Automatically Collected Information:

In addition, the application may automatically collect certain information, including, but not limited to, the type of mobile Device you use, its unique Device ID, the IP address, your mobile operating system, the type of mobile internet browsers you use, and information regarding your usage of the application.

We may also collect information that your browser sends whenever you visit our service or access it through a mobile Device.

Information Collected while Using the Application:

While using our application, to provide its features, we may collect information with your prior permission:

• Information regarding your location.
• Permission to Read, Write, and Delete the file (files that are created and stored by the Application/Service) from your internal Device’s storage.

We use this information to provide features of our application, to improve and customize our service. The information may be uploaded to the Company's servers and/or a Service Provider's server or it may be stored solely on your Device.

You can enable or disable access to this information at any time, through your device Settings.

Use of Your Personal Data

The organization may use personal data for the following purposes:

• To provide and maintain our service, including monitoring Service usage.
• To manage Your Account: to manage your registration as a user and provide access to different functionalities.
• To contact You: via email,telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile Application's push notifications for updates or informative communications, products or contracted Services, or security updates.
• To manage your requests: attending to and managing your inquiries.
• For business transfers: evaluating or conducting mergers, divestitures, restructuring, reorganization, dissolution, or other asset transfers, as a going concern or as a part of bankruptcy, liquidation, or similar proceedings, in which Personal Data held by us about our service users is among the assets transferred.
• For other purposes: data analysis, identifying usage trends, assessing promotional campaigns effectiveness and improving overall service, products, Services, marketing and user experience.

We may disclose User Provided and Automatically Collected Information:

• As required by law, such as to comply with a subpoena, or similar legal process.
• When we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, investigate fraud, or respond to a government request.
• With our trusted Service providers who work on our behalf, do not have independent use of the disclosed information, and have agreed to adhere to the rules set forth in this privacy statement.

You can easily stop all collection of information by uninstalling application. You may use the standard uninstall processes available through your mobile Device or via the mobile Application marketplace or network.

Other legal requirements:

The company may disclose your personal data in the good faith belief that such action is necessary to:

• Comply with a legal obligation.
• Protect and defend the rights or property of our organization.
• Prevent or investigate possible wrongdoing in connection with application.
• Protect the personal safety of users of the Application or the public.
• Protect against legal liability.

Data Retention Policy, Managing Your Information:

We will retain user-provided data for as long as you use the Application and for a reasonable time thereafter. Automatically collected information will also be retained for a reasonable period depending on the nature of the Application and may then be stored in aggregate. Please note that some or all of the user-provided data may be required for the Application to function properly.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a reasonable period, unless it is used to strengthen security or improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

E-mail Messages

E-mail messages, sent to any South Carolina State Government address will be treated the same as any other written communication. They may be subject to public inspection or legal disclosure and may be saved for a period before they are destroyed. E-mail or other information requests sent to the state website may be retained to respond to the request, forward it to the appropriate agency, or provide the web designer with valuable customer feedback to improve the site. E-mail addresses obtained from a request to the state site will not be sold or given to private companies for marketing purposes. E-mail logs for incoming e-mail concerning sender’s and receiver’s identification and the date and time that the message was sent are also maintained. The e-mail log does contain the message sent.

Electronic Forms

Any other information provided by a visitor at the request of an agency of the South Carolina State Government, such as completing and electronic filing of a form, will be voluntarily provided by the visitor and treated in the same manner as information provided in written form or in person during a visit to the agency. Information provided may be subject to public inspection and legal disclosure, saved for a period before it is destroyed and shared with another state agency for appropriate action.

Transfer of Your Personal Data:

Your information, including personal data, is processed at our operating offices and other locations where the parties involved in processing are located.This means that the information may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction, where the data protection laws may differ from those in your jurisdiction.

Misuse by Non-Targeted Users:

All mobile apps are meant for use by the targeted audience only. Owners of the mobile Devices should prevent misuse by non-targeted users.

We are committed to safeguarding the confidentiality of your information.We employ physical, electronic, and procedural safeguards to protect the information we process and maintain. For instance, we restrict access to this information to authorized employees and contractors who require it to operate, develop or improve our application. However, please note that while we strive to provide reasonable security for the information we process and maintain, no security system can prevent all potential security breaches.

The security of your personal data is important to Us, but it’s essential to remember that no method of transmission over the Internet,or electronic storage is entirely secure. While we employ commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.

Our Application does not address any individuals under the age of 13. We do not knowingly collect personally identifiable information from anyone in this age group. If you are a parent or guardian and become aware that your child has provided us with personal data, please contact us.
